Existe una confusión muy extendida entre quienes inician trámites en España: having a NIE does not mean being a resident. At Adlanter we see it every day: people who believe that having a NIE already allows them to live or work in Spain, when in reality it is only an administrative identification number.
In this guide, we explain clearly and practically what having a NIE implies, why it does not equal residency, the role of the TIE, and in which cases you actually become a legal resident in Spain.
What is the NIE?
The NIE (Foreign Identity Number) is a personal and non-transferable number used to identify any foreign person before Spanish authorities.
- It is just a number, not a card.
- It does not prove legal residency.
- It does not authorize you to work.
- It does not imply any immigration status.
- It can be obtained without living in Spain.
If what you need is to apply for a NIE for administrative procedures without residing in Spain (buying property, opening a bank account, notary appointments, taxes), we recommend reading the complete guide to the non-resident NIE: Non-resident NIE in Spain: complete guide
In which cases is the NIE issued in Spain?
Many people do not know that the NIE can be issued in very different situations:
NIE assigned automatically
- When a foreigner starts a stay or residence procedure. (Note: a visa does not generate a NIE by itself)
- When an administrative expulsion or mandatory departure process begins.
Any foreign person can request a non-resident NIE if they need to carry out certain procedures in Spain, such as:
- Buying a property
- Setting up a company
- Acting as director or partner
- Appearing before a notary
- Finalizing an inheritance
- Opening a bank account
- Handling specific tax procedures
To request a non-resident NIE, it is essential:
- Not to be in an irregular situation
- To justify the purpose with documentation
- To submit the application in Spain or from the country of origin
What is the TIE and how does it relate to the NIE?
The TIE (Foreigner Identity Card) is a physical document (card) that proves you have a stay or residence permit.
It includes:
- Your NIE
- Your personal details
- Your photo
- Your fingerprints
- The type of authorization granted
- Its validity
Key relationship:
- Everyone who has a TIE has a NIE.
- Not everyone who has a NIE has a TIE.
Special case: EU/EEA/Swiss citizens
They receive a Certificate of Registration as an EU Citizen (green NIE), not a TIE.
Does having a NIE mean being a resident?
Having a NIE does NOT make you a resident.
Being a resident means having a granted residence permit.
The NIE is simply a number that identifies you for administrative, tax, notarial or economic purposes.
You are only a legal resident when: You have a residence permit (temporary, long-term, EU family member, etc.) and obtain your TIE (or green certificate if you are an EU citizen).
If you only have a NIE:
❌ You are not a resident
❌ You cannot work
❌ You do not have residents’ rights
❌ You cannot stay indefinitely in Spain

How is the TIE requested?
To apply for the TIE, you must first have an approved stay or residence authorization.
Then:
- Request an appointment at Immigration or Police.
- Submit your passport, approval resolution and photos.
- Pay the corresponding fee.
- Provide fingerprints.
- Pick up your TIE a few weeks later.
Remember: Renewing your residence means renewing your TIE, but NOT your NIE, which always remains the same.
